ReplyDeleteKathi Carney is currently married to Robert Carney, who was a party to a lawsuit in the 247th District Court of Harris County, Texas, bearing Cause No. 1985-05054 and styled In the Matter of the Marriage of Rhonda R. Carney and Robert P. Carney and in the Interest of Travis B. Carney, A Minor Child.
On 2-2-1994 the Court entered judgment in the nature of child support against Robert P. Carney in the amount of $2340.04 plus court costs of $107.00 plus simple interest thereon at the rate of 12% per year from the date of judgment until paid. Robert Carney walked away from this child support obligation, so the file eventually landed on my desk. I tracked him down and gave him an opportunity to clear it up. He refused to pay the back child support, so the court on 29 January 2014 suspended his electrician license until he finally paid. That's what happens to deadbeats who don't pay their child support.

Now it appears that Robert Carney posted the above untrue defamatory statements using his wife's google social media account. Apparently he wants to be taken back to court, this time for libel.
Some guys just never learn. Go figure.

DeleteAs a professional bonded debt collector, I actually have to chuckle when reading a weepy whiny post by some pathetic judgment debtor whose case I handled. ("There there, Bobby, everything will be alright, now just take a deep breath and show us, using the doll, where the big bad debt collector touched you...")
ReplyDeleteI've been in this line of work 17 years, so it was only inevitable that some debtors would make up stories and file false complaints with the Better Business Bureau, regulatory agencies, mediators, and courts about me. And in each and every case after careful investigation the matter has been resolved in my favor. None of complaints are sustained. I understand that guys like Carney would take it personally when uses the courts to hold a child support deadbeat accountable, but for me it's all just business. I've never met Carney, never even spoken with him on the phone. As of this moment I have no idea what he even looks like although that will change tomorrow when I obtain a copy of his mugshot from the last time that he went downtown in the back of a squad car.

ReplyDelete2. I am not an "advocate for deadbeats"; I'm a professional debt collector who works cases so that creditors can get the money they were awarded by the courts. I do not call debtors on the phone to beg for dollars; I am not a phone pest. I review the file, investigate the debtor, and then use all legal remedies available to lawfully collect the debt. Most people get paid to show up; I get paid to go away.
3. I did not "make old attorney's fees look like old child support" and then "get a judge to sign off on it." I am not a lawyer and have no idea how even to do such a thing even if I wanted to. The judgment entered against Mr. Carney on 2-2-1994 was "in the nature of child support." It says so right there on the judgment. I had nothing to do with the entry of this child support judgment against Mr. Carney.
4.Mr. Carney had fallen behind on his child support, so the mother of his child was forced to hire attorney Patsy Young to file a motion for contempt against him and haul his delinquent butt before Judge Bonnie Hellums. There was a hearing, Mr. Carney's ex-wife prevailed, and so Patsy Young was awarded a judgment against Mr. Carney for her attorney fee "in the nature of child support." Mr. Carney walked away from this child support obligation, so the case was turned over to my office.
5. On 10-17-2013 Mr. Carney was served with a citation and petition to suspend professional license of delinquent child support obligor. Mr. Carney failed to file an answer.
6. On 1-17-2014 the court held a hearing on the matter and once again ruled against Mr. Carney. On 1-29-2014 the court ordered the suspension of Mr. Carney's professional license for non-payment of child support. That's when Mr. Carney finally performed a rectal-cranial extraction on himself and got to a lawyer. The lawyer informed Mr. Carney that I had him by the Mr. Mr. Carney, and that he had to pay up.
7. I bear Mr. Carney no ill will. Apparently Mr. Carney still feels a lot of anger towards me for working the case. For me, it's all just business.
8. If Mr. Carney really wanted to hurt my reputation, he wouldn't beg for pity on the internet and cry on about what a big meany I am. That just makes him look pathetic while giving me free advertising. If I wanted to hurt a debt collector's reputation, I'd probably start rumors that he's actually a nice guy with a soft heart.
9. If Mr. Carney were really smart, he'd put his personal feelings aside, understand that business is business, and keep my business card. Mr. Carney is the owner of a small business and undoubtedly runs into the problem from time to time of not getting paid on a job, and thus could benefit from having a big mean debt collector on call. I know that it sounds strange, but I have actually gotten referrals from guys against whom I worked cases. Why? Because in my dealings with them I am polite and professional, and I am effective.

Perhaps Mr. Carney you should read up on the law when it comes to anything attached to a case in the nature of child support.

Whether or not you gained custody of your son at any point is mute. It does not matter that you raised your son nor that he is now in his 30's nor that you haven't spoken to Rhonda in over a decade. What matters is that you never paid the monies the court rendered judgment against you on.
Slander is prosecutable, definitely. But I nor anyone in the Judgment Enforcement business would see anything Mr. Fason said as slander & I highly doubt any judge would either. If you went to an attorney & inquired into all this I am positive he would say the same.
As far as you hiring Mr. Fason personally, I see no reason why you would need to unless you have a judgment that you won & need assistance in collecting. Mr. Fason's business is just that. He works with not only new cases assigned to him by the original judgment creditors but on cases that are so old there not many in our business will touch them. That takes guts.
Working judgment enforcements takes money out of our own pockets with no guarantee of payment in the end. Again...that takes guts & good judgment on what is collectable & what is not.
As far as the case being so outdated....yes...it was. But again...there was no Statue of Limitations in this case. If you would have paid the monies then Bill Fason would not have been assigned the case nor looked into it.
Having known of Bill's business pursuits for well over a decade, I know he is extremely thorough in his work. He knows his stuff far better and far more effective in his pursuits than 99+% of Texas attorneys.
ReplyDeleteLike Mr. Carney, Jose Guajardo didn't take it well that I worked an unpaid money judgment involving him, so indeed he filed lawsuit against me under Cause No. 2010-31039. If Mr. Carney knew how to make sense of court documents, he would see that on 12-16-2010 my attorney filed a motion for summary judgment. On 1-26-2010 the court held a hearing on the matter and granted my motion, essentially dismissing Guajardo's claims. On 7-21-2011 Guajardo filed a non-suit. I never paid Guajardo a dime. The only thing Guajardo got was a bill from his attorney.

Not knowing Mr. Carney as I know you, I cannot speak on his character. Though the more he posts here the more we all get a good laugh.
